A non-compete clause in a fixed-term contract is only valid if the employer can demonstrate a substantial business interest in writing at the time of signing. Broad geographic or time restrictions are frequently challenged in Dutch courts. As an expat, your 30% ruling may affect portability to new employers — review any non-compete before signing and before resigning.
